1. Acceptance of Terms

By accessing or using Creativity Blaster (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of the Service

Creativity Blaster is a software platform that helps users manage marketing content, upload and organize media, and schedule or publish content to third-party social media platforms. Features may change over time. We may modify, suspend, or discontinue any part of the Service at any time without liability.

3. Accounts and Eligibility

• You must provide accurate account information and keep your credentials secure.
• You are responsible for all activity that occurs under your account.
• You must be legally able to enter into these Terms in your jurisdiction.
• We may suspend or terminate accounts that violate these Terms or appear fraudulent or abusive.

4. User Content and Responsibilities

You retain ownership of content you upload or create (“User Content”). By using the Service, you grant us a limited license to host, process, transmit, and display User Content solely as needed to operate the Service (including publishing to platforms you authorize).

You represent and warrant that:

• You own or have all rights necessary to use and publish your User Content.
• Your User Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights.
• Your User Content complies with applicable laws and the terms of any social platforms you use.
• You will not upload malware, unlawful material, or content that is defamatory, harassing, or harmful.

5. Third-Party Platforms and Services

The Service integrates with third-party services such as Facebook, Instagram, TikTok, LinkedIn, YouTube, X (Twitter), and others. Those platforms are independent of Creativity Blaster. Your use of them is governed by their own terms and policies.

• We are not responsible for third-party outages, API changes, policy changes, account bans, or content removals.
• Connecting an account authorizes us to act on your behalf within the permissions you grant (for example, publishing scheduled posts).
• You can disconnect accounts at any time from your account settings; residual tokens may remain until revoked on the third-party platform.

6. Automated Features and AI-Assisted Content

The Service may include automation, scheduling, analytics, and AI-assisted tools. Outputs may be inaccurate, incomplete, or unsuitable for your use case. You are solely responsible for reviewing, editing, approving, and publishing any content before it is released to the public or to third-party platforms.

7. Acceptable Use

You agree not to:

• Use the Service for spam, deception, unauthorized advertising, or unlawful activity.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Interfere with or disrupt the Service, including through excessive automated requests.
• Reverse engineer, scrape, or misuse the Service except as allowed by law.
• Misrepresent your identity or affiliation when using connected social accounts.

8. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Creativity Blaster or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to identify the Service.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will be successfully published to any platform at any particular time. Scheduling and publishing features depend on third-party availability and your connected credentials.

10. Limitation of Liability

To the maximum extent permitted by law, Creativity Blaster and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Service.

Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim, or (b) one hundred U.S. dollars (US $100), if you have not paid any fees.

11. Indemnification

You agree to defend, indemnify, and hold harmless Creativity Blaster and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your use of third-party platforms; or (d) your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if you violate these Terms, create risk or legal exposure for us, or if required by law. Upon termination, your right to use the Service ends, though provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above will change when we do. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, discontinue use of the Service.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where the Service operator is established, without regard to conflict-of-law principles. Courts in that jurisdiction will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law.

15. Fees and Refunds

Paid plans, subscriptions, and add-ons are billed as described at checkout or on our pricing page. All sales are final. Except where required by applicable law, Creativity Blaster does not issue refunds. Full details are in our Refund Policy, which is incorporated into these Terms by reference.
